These Terms of Use are an agreement between you and PixelAlphaStudio ("we", "us") covering your use of the Weather Android app and everything in it. By installing or using the app you accept these terms. If you do not accept them, please uninstall the app.

Who may use the app

The app is intended for people aged 13 and over. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian who accepts these terms on your behalf. You are responsible for making sure your use of the app is lawful where you are.

Your licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use. We keep all rights not expressly granted here.

Weather information is not a safety service

This is the most important section of these terms, so please read it.

Forecasts, current conditions, radar imagery, air quality figures, activity indexes, severe weather warnings, and earthquake information in the app come from third-party data providers. Weather and seismic data are predictive and imperfect by nature. Readings may be delayed, incomplete, wrong, unavailable, or inconsistent with what you observe outside, and the app depends on an internet connection and on providers we do not control.

Do not rely on this app for decisions where safety, health, property, or life may be at risk. It is not an emergency alerting system and it is not a substitute for your official national weather service, meteorological department, or disaster management authority. For severe weather, cyclones, flooding, earthquakes, or any emergency, follow the warnings and instructions issued by those official agencies and by local authorities. The app must not be used as a primary information source for aviation, marine navigation, agriculture at scale, construction, emergency response, or any other activity where inaccurate weather data could cause harm or loss.

Earthquake information is reported after the fact by seismic monitoring networks and is not, and cannot be, an early warning.

Third-party content

The app displays news articles, map and radar tiles, and other material supplied by third parties. That content belongs to its owners, is provided for your convenience, and does not represent our views. We do not verify, endorse, or take responsibility for third-party content, and opening a link or article may take you to a site governed by its own terms and privacy policy.

Advertising

The app is free and funded by advertising. Ads are supplied by Google AdMob and its mediated ad networks, and we do not control or endorse what they show or what advertisers claim. Any dealing you have with an advertiser is between you and them. You agree not to interfere with the display of ads or use any method to generate artificial ad impressions or clicks.

Device permissions and features

Some features need Android permissions such as location, notifications, and display over other apps. Granting them is your choice, and you can withdraw any of them at any time in your device settings. Features that depend on a permission you have declined will be limited or unavailable. The floating Quick Access bubble and the daily notification run as long as you leave them enabled and may use battery and mobile data. Data charges from your mobile operator are yours to pay.

What you may not do

• Copy, modify, translate, redistribute, sell, rent, sublicense, or create derivative works from the app or any part of it.
• Reverse engineer, decompile, or disassemble the app, or try to extract its source code, keys, or API credentials, except where law expressly permits it.
• Extract, scrape, cache, or resell the weather, map, news, or seismic data the app displays, or access the underlying data services outside the app.
• Use bots, emulators, or automated tools to interact with the app, or send it automated or excessive requests.
• Interfere with the app's security features, ad delivery, or normal operation, or attempt to gain unauthorised access to any related system.
• Use the app for anything unlawful, or in any way that infringes someone else's rights.
• Remove or obscure any copyright, trademark, or ownership notice.

Ownership

The app, its source code, design, interface, icons, illustrations, themes, and the PixelAlphaStudio name and logo are owned by us or licensed to us, and are protected by copyright and other laws. Trademarks of third parties that appear in the app belong to their respective owners.

Changes to the app

We may add, change, suspend, or remove features at any time, and we may stop supporting older versions or discontinue the app entirely. Updates may be delivered through Google Play and are subject to these terms. We are not obliged to maintain any particular feature, and we are not liable for any feature being withdrawn.

Google Play

The app is distributed through Google Play, and your use of it is also subject to the Google Play Terms of Service. Google is not a party to these terms and has no responsibility for the app or for supporting it. Refunds, where applicable, are handled under Google Play's own policies.

No warranty

The app is provided "as is" and "as available", without warranty of any kind. To the fullest extent the law allows, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty about the accuracy, reliability, timeliness, or completeness of the weather or seismic information shown. We do not warrant that the app will be uninterrupted, error-free, secure, or compatible with every device.

Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you, and nothing here limits rights you have under mandatory consumer protection law.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profit, data, goodwill, or property, arising from your use of the app or from reliance on the information it displays. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or INR 1,000.

Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these terms or your misuse of the app.

Termination

This licence ends automatically if you breach these terms, and you may end it at any time by uninstalling the app. The sections on ownership, no warranty, limitation of liability, indemnity, and governing law survive termination.

Governing law and disputes

These terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any non-waivable right you have to bring proceedings where you live, the courts at [CITY, STATE] shall have exclusive jurisdiction over any dispute arising out of these terms or the app.

General

If any provision of these terms is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us about the app. You may not assign your rights under these terms; we may assign ours in connection with a merger, acquisition, or sale of assets.

Changes to these terms

We may revise these terms as the app or the law changes. The revised version will be posted at this address with a new "last updated" date, and material changes will be announced in the app or in the Play Store listing. Continuing to use the app after a revision takes effect means you accept it.
